Request a review of your homelessness decision

If you are unhappy with the decision made on your homelessness application you have a right to request a review of that decision.

How do I request a review of a decision on my Homeless application?
A review can be requested by completing a review form. The review form can be obtained from a Local Service Centre or the Housing Options Centre.The completed review form should be sent to:

A review request can be made on your behalf by another person.

Are there time limits on making a review request?
Any request for a review should be made within 21 days of you being notified of the decision. The Council does have discretion to accept or reject a request for a review made after this period has elapsed.

What decisions can be reviewed?
If the Council decides you are not eligible for assistance, do not have a priority need, became homeless or threatened with homelessness intentionally, or you do not have a local connection with this borough you can request a review. You can also request a review of the suitability of any temporary accommodation whether or not you accept the offer. You cannot however request a review of the suitability of emergency accommodation offered to you pending the completion of enquiries into your application.

Do I need to provide any additional information?
If you wish to request a review, you, or someone acting on your behalf, should make written representations and provide any new information that you may have in support of your request for a review. All the information provided will be considered and assessed by the Review Officer, who may also invite you to attend an interview. When the Review Officer has completed the review you and/or your representitive will be advised of the outcome in writing.

How long does the Reviews Manager/Officer have to complete the review?
Reviews have to be completed within 8 weeks of the date that the review was requested. It is however possible for extensions be agreed in some circumstances.

Does the Council have to accommodate me while the review is being conducted?
The Council does not have a duty to provide you with accommodation while the review is being carried out. However, if there are exceptional circumstances, the Council may provide you with accommodation pending the review being completed.

What can I do if I am not satisfied with the Review decision?
If you are dissatisfied with the review decision, you can appeal on a point of law to the County Court. You must appeal to the County Court within 21 days of the date on which you are notified of the review decision. Should you wish to appeal to the County Court it is advisable that you seek independent legal advice.
