Exemptions

break

There are 23 exemptions (Absolute and Non Absolute) from your general right of access.

These include:

  • Court Records
  • National Security
  • Applicant's Personal Data
  • Breach of Confidence
  • Law Enforcement
  • Health & Safety
  • Information, which is published
  • Information, which will be published

We have to apply the 'public interest test' to non-absolute exemptions.

If you are unhappy with the response you receive, you must first raise a complaint with us. If you are still unhappy following the completion of our complaints procedure you may then complain to the Information Commissioner, who will decide if your request was handled properly.

Complaints could relate to any of the following:

  • Failure to provide information
  • Exceeding time limits
  • Charging excessive fees
  • Failure to advise and assist
  • Failure to publish in accordance with the Publication Scheme
