Local Land Charges Search

When you buy a property or a piece of land, it is important that you or your solicitor ask for a local land charges search to make sure there are no charges affecting the land or property.

About local land charges

A local land charge is a restriction on a piece of land or property that can limit its use or bind the owner to a payment of a sum of money. Charges can include:
  • planning decisions
  • road agreements
  • tree preservation orders
  • conservation areas and listed buildings notices
  • environmental health notices
  • charges or objections made against previous owners.
A local land charges search will highlight these charges and help you to make an informed choice about buying the parcel of land or property.

Official local land charges searches

In most cases your solicitor will ask the council to do the search. This is because councils do all official searches covered by the Local Land Charges Act 1975.

We are able to collect information from lots of different departments including planning and building control and bring it together to form a local authority search.

An official local authority search is made up of two types of searches:

Local land charges search (Form LLC1)

This is a search of the local land charges register. It shows any charges affecting the land or property, such as planning decisions and tree preservation orders, and details of money owed to the council by previous owners.

Local authority search (Form CON29)

This search reveals any planning, highway or environmental issues that either affect your land or property now, or could affect you in the future.

It includes an optional section (CON29O) which covers any common land enquiries such as public paths and pollution orders. The majority of the information comes from departments within the council.

In accordance with HMRC ruling in December 2016, London Borough of Newham Land Charges will start charging VAT (20%) on Con29 searches from 31 March 2017. LLC1 charges remain unchanged.

How long will the searches take?

An official search takes one to three days to complete. We will send the results to you by post or DX post once it is complete, or via email if you'd prefer.
