Eviction process: step by step
Key point
A landlord cannot evict you just by giving you a notice. They must follow the legal process.
Step 1: Notice period
If the notice is valid, it remains valid for 12 months.
Step 2: Court (possession order)
If you stay in the property, the landlord can apply to court for a possession order after the expiry date on the notice.
You will be sent information about:
- the hearing date
- what you need to do next
The time it takes can vary depending on how busy the court is.
Step 3: Bailiffs (eviction)
If a possession order is granted and you have not moved out by the date in the order, the landlord can ask bailiffs to evict you.
The bailiffs will write to you with a notice of eviction. This will give you at least 14 days’ notice before you must leave your home.
