Disputing a PCN on a broken down vehicle

Before submitting an Informal Challenge or Formal Representation, it is helpful to:

  • View evidence of the Penalty Charge Notice (PCN) online.
  • Understand the parking or driving rules and restrictions relevant to the PCN.
  • Consider carefully the reason(s) why you believe the PCN was issued incorrectly.

It is strongly recommended to submit evidence to support the reasons for disputing the Penalty Charge Notice (PCN). Disputes without supporting evidence are unlikely to be accepted.

Disputes based on mitigating circumstances (significant or unavoidable events that are beyond the motorist's control) may be considered on a case by case basis.

A dispute may be accepted if:

  • the vehicle experienced a genuine mechanical failure that prevented it from being moved
  • You were attending another vehicle that had broken down

A dispute may be rejected if:

  • the breakdown was due to avoidable negligence, such as running out of fuel
  • the breakdown was due to persistent problems
  • the vehicle was left unattended for an extended period without any action taken to resolve the issue

Examples of evidence include:

  • an invoice or receipt from the recovery service that assisted the vehicle
  • invoice or receipt of repair or parts paid to fix the vehicle
