Disputing a PCN due to loading

Before submitting an Informal Challenge or Formal Representation, it is helpful to:

  • View evidence of the Penalty Charge Notice (PCN) online.
  • Understand the parking or driving rules and restrictions relevant to the PCN.
  • Consider carefully the reason(s) why you believe the PCN was issued incorrectly.

It is strongly recommended to submit evidence to support the reasons for disputing the Penalty Charge Notice (PCN). Disputes without supporting evidence are unlikely to be accepted.

Disputes based on mitigating circumstances (significant or unavoidable events that are beyond the motorist's control) may be considered on a case by case basis.

A dispute may be accepted if:

  • the loading or unloading was for commercial activities, such as if you were actively loading or unloading goods as part of your job and evidence is provided
  • the loading or unloading of commercial goods was completed within a reasonable time frame, typically under 20 minutes
  • there was no available loading bay and you had to park on a restricted street to load or unload commercial goods

A dispute may be rejected if:

  • the motorist was conducting personal shopping or non-commercial activities
  • the motorist was simply waiting for goods to be brought out, or for someone to arrive
  • the loading or unloading took an excessively long time without valid reasons

Examples of evidence include:

  • delivery notes on headed paper, proving the delivery or collection of goods
  • invoices on headed paper, proving the delivery or collection of goods
