Letters from an Enforcement Agency (bailiffs)
If a Penalty Charge Notice (PCN) has not been paid within 21 days of the Order for Recovery being served:
- The Council will ask the court for a Warrant of Control.
- Once the warrant is granted, the debt will be passed to a certified enforcement agency (bailiff).
A warrant authorises an enforcement agency to collect debts on behalf of the Council, this can involve taking control of the debtors belongings and selling them to pay off what is owed.
At this stage the Council cannot discuss the case or take payment.
If you have been contacted by an enforcement agency
You are still able to view evidence of the Penalty Charge Notice (PCN).
You must either:
a) Contact the enforcement agency
or
b) Make an 'out of time' challenge
a) Contact the enforcement agency (bailiff) to:
- pay the debt
or
- provide evidence that you were not the owner of the vehicle at the time of the PCN was issued.
Notify the agency if you are experiencing financial hardship, and are struggling to pay the debt, or if you have accessibility requirements.

The Council may also recycle warrants that have not been recovered to other enforcement agencies.
b) Make an 'Out of Time' challenge
You may be able to get more time to dispute a court order if:
- you were not aware of the Penalty Charge Notice (PCN)
- the PCN has already been paid or cancelled
- you did not get a response to a Formal Representation or appeal.

Once notification of an 'Out of Time' challenge has been received by the Traffic Enforcement Centre (TEC), the actions of the enforcement agent will be put on hold temporarily.
If you do nothing:
The enforcement agency will take action to recover the amount owed.
The enforcement agent is allowed to charge recovery fees for every letter, visit and action taken as part of the effort to recover the outstanding amount. This will increase the debt owed.
