Guidance on how to write a challenge or representation

Before submitting an Informal Challenge or Formal Representation, it is helpful to consider the reason(s) why the Penalty Charge Notice (PCN) should be cancelled.

Check information on the common reasons PCNs are disputed, which includes examples of evidence you may wish to provide:

Unclear signs
Loading
Cloned & Stolen vehicles
Blue badge holders
Hire vehicles
Broken down vehicles
PCN on a recently bought or sold vehicle
Medical emergencies
PCN or letter was not received or delivered late

What to include:

  1. The reasons why you believe the Penalty Charge Notice (PCN) is incorrect. Explain these carefully and in detail in the written statement. Check the grounds (reasons) why a PCN may be cancelled.
  2. Evidence to support and back up the reason. This could include photographs or copies of documents. It is recommended to include evidence as part of the Informal Challenge or Formal Representation, but it is not compulsory.

When disputing a Penalty Charge Notice (PCN) online, if you provide the contravention code and reason for dispute to a chat bot (Max) you will be offered advice. There is also an option to have the dispute written for you have received advice and then indicate that you intend to dispute the PCN.

How decisions are made

A Penalty Charge Notice (PCN) is a legal document issued when a vehicle has been seen breaking a parking or traffic rule. For that reason, the legal/ statutory process must be followed when deciding the outcome to an Informal Challenge or Formal Representation.

Full consideration is given to:
a)    the legislation relevant to the PCN
b)    the statement submitted as part of the Informal Challenge or Formal Representation
c)    all evidence that is made available.
